Privacy Policy of BCSCore LLC regarding the processing of personal data

1. General Provisions.

1.1. This Personal Data Processing Policy (hereinafter referred to as the “Policy”) defines the basic principles, purposes, conditions and methods of personal data processing, the categories of data subjects and personal data processed by the Operator, the Operator’s functions in the course of personal data processing, the rights of personal data subjects, as well as the measures implemented by the Operator to protect personal data.

1.2. The Policy has been developed and approved in accordance with Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data”, as well as Federal Law No. 149-FZ dated July 27, 2006 “On Information, Information Technologies and Information Protection”, and other regulatory legal acts of the Russian Federation governing relations related to personal data processing.

1.3. The Policy applies to all information recognized as personal data under the legislation of the Russian Federation that is provided by the User to the Operator while visiting and using the Website, as well as while interacting with the Operator regarding services, requests, applications, and other inquiries.

1.4. The Operator may also receive personal data from its partners, services, and contractors if this is necessary to fulfill the Operator’s obligations to the User or to process the User’s requests. In such cases, personal data processing shall be carried out in accordance with the legislation of the Russian Federation and based on the relevant agreements.

1.5. The Policy is a publicly available document. By using the Website, the User agrees to this Policy to the extent applicable to the relevant method of using the Website.

1.6. If the User disagrees with the terms of the Policy, the User must stop using the Website.

2. Basic Terms.

Personal Data means any information relating directly or indirectly to an identified or identifiable individual (personal data subject), including the User.

Information means any information (messages, data) regardless of the form in which it is presented.

Operator means Limited Liability Company “BCSCore” (BCSCore LLC, OGRN: 1267800024469, INN: 9810008847, KPP: 781001001), registered at: 196240, Saint Petersburg, Leninsky Ave., Building 153, Structure 1, Premises 89N.

User means any individual visiting and/or using the Website.

Website means a combination of software and hardware tools for computers ensuring the publication of information and data for public access through technical means used for communication between computers on the Internet. The Website is available at: https://bcscore.ru/.

Partners means third parties acting on the basis of agreements concluded with the Operator, including contractors, technology partners, service organizations, and other persons assisting the Operator in fulfilling its obligations or ensuring the operation of the Website and related services.

Personal Data Processing means any action (operation) or set of actions (operations) performed with or without the use of automation tools involving personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (provision, access), anonymization, blocking, deletion, and destruction of personal data.

Automated Personal Data Processing means the processing of personal data using computer technology.

Provision of Personal Data means actions aimed at disclosing personal data to a specific person or a specific group of persons.

Distribution of Personal Data means actions aimed at disclosing personal data to an indefinite group of persons.

Blocking of Personal Data means the temporary suspension of personal data processing, except where processing is required for clarification of personal data.

Destruction of Personal Data means actions resulting in the impossibility of restoring the content of personal data in a personal data information system and/or resulting in the destruction of physical media containing personal data.

Anonymization of Personal Data means actions resulting in the impossibility of determining the принадлежность personal data to a specific personal data subject without the use of additional information.

Personal Data Information System means a set of personal data contained in databases and the information technologies and technical means ensuring their processing.

3. Personal Data Processed by the Operator.

3.1. The Operator may process the following personal data of Users:

  • surname, first name, patronymic (if applicable);
  • phone number;
  • email address;
  • information about the legal entity represented or employed by the User, including the company name, registration address, INN, OGRN, and other identifying information;
  • other information provided by the User while using the Website functionality, submitting applications, requests, and other inquiries.

3.2. Depending on the specific interaction scenario, the Operator may process not all of the information specified in Clause 3.1 of the Policy, but only the part necessary to achieve the relevant purpose of processing.

3.3. When using the Website, Cookies and other technical information about the user’s device and actions on the Website may also be automatically transmitted to the Operator.

3.4. Cookies are fragments of data stored in the browser of a computer, mobile phone, or other device used to access websites on the Internet.

3.5. Through Cookies, the Operator may receive the following information originating from the User: IP address, MAC address, external referral source to the Website (including backlinks), PHP session identifier, information about the software and hardware used by the User to access the Internet, communication channels, information and materials transmitted and received through the Website, information about the User’s behavior on the Website, as well as other similar information.

3.6. The User may independently delete Cookies and prohibit their transfer using the functionality of their browser.

3.7. By using the Website, the User expresses consent to the transfer of Cookies unless the option specified in Clause 3.6 of the Policy has been implemented by the User with respect to the Website.

4. Consent to Personal Data Processing.

4.2. The User independently determines the scope of personal data for which consent to processing is granted to the Operator.

4.3. The Operator ensures the receipt of explicit, specific, informed, unambiguous, and freely given consents from Users for the processing of personal data where such consent is required.

4.4. The User’s consent to personal data processing may be provided to the Operator in one of the following ways:

  • by placing a mark in the relevant field under forms posted on the Website that provide for the User’s submission of personal data to the Operator;
  • by providing an email address and other data on the Website for the purposes of receiving feedback, consultations, offers, subscriptions, or submitting applications;
  • by providing written consent executed in simple written form and/or in the form of an electronic document signed with an electronic signature in accordance with the legislation of the Russian Federation.

4.5. The Website may contain feedback forms, application forms, chat modules, and other communication tools. By providing personal data through such functionality, the User expresses consent to its processing in accordance with this Policy.

5. Purposes of Personal Data Processing.

5.1. The User’s personal data is processed by the Operator for the following purposes:

  • 5.1.1. Compliance with the requirements of the legislation of the Russian Federation.
  • 5.1.2. Identification of the User when interacting with the Website and the Operator’s services.
  • 5.1.3. Processing applications, requests, inquiries, and other messages received from the User.
  • 5.1.4. Establishing and maintaining feedback with the User, including sending notifications, information, and responses regarding the Operator’s activities, use of the Website, and provision of services.
  • 5.1.5. Preparation, conclusion, and execution of contracts and agreements, including with legal entities represented by the User.
  • 5.1.6. Providing the User with consulting, customer, and technical support related to the use of the Website, services, and offerings of the Operator.
  • 5.1.7. Improving the quality, functionality, content, and user experience of the Website.
  • 5.1.8. Sending informational and marketing messages if the User has provided the relevant consent.
  • 5.1.9. Conducting analytics, statistical, and other research for the development of the Website, services, and offerings of the Operator.

5.2. For statistical analysis and research purposes, the Operator may use web analytics services subject to compliance with the legislation of the Russian Federation.

6. Conditions of Personal Data Processing and Measures to Ensure Their Security.

6.1. The Operator processes Users’ personal data no longer than required by the purposes of personal data processing unless otherwise provided by the legislation of the Russian Federation.

6.2. The User has the right to terminate the processing of personal data early by withdrawing consent to personal data processing by contacting the Operator in writing at the address specified in Section 2 of the Policy and/or by email at: support@bcscore.ru.

6.3. Upon termination of personal data processing, the personal data shall be destroyed or anonymized unless otherwise provided by the legislation of the Russian Federation.

6.4. In cases expressly provided for by the legislation of the Russian Federation, personal data may be processed without the User’s consent.

6.5. For the purposes of processing Users’ personal data, the Operator has the right to provide personal data to third parties to the extent necessary to achieve the relevant purpose of processing, provided that such persons comply with the legislation of the Russian Federation on personal data.

6.6. The User’s personal data may be transferred to authorized state authorities of the Russian Federation only on the grounds and in the manner established by the legislation of the Russian Federation.

6.7. The Operator takes necessary legal, organizational, and technical measures to protect the User’s personal data from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, and other unlawful actions of third parties.

6.8. The security of personal data is ensured through the implementation of the following measures:

  • publication and placement of this Policy in open access on the Website;
  • adoption of local acts regarding the processing and protection of personal data;
  • appointment of a person responsible for organizing personal data processing;
  • application of necessary information protection measures;
  • detection of unauthorized access to personal data and implementation of appropriate measures;
  • establishment of access rules for personal data, as well as ensuring registration and accounting of actions performed with personal data;
  • control over the measures taken to ensure the security of personal data;
  • assessment of the effectiveness of the measures taken to ensure the security of personal data.

7. Rights and Obligations of the Parties.

7.1. The User has the right to:

  • 7.1.1. Decide whether to provide personal data to the Operator.
  • 7.1.2. Withdraw consent to the processing of personal data at any time where processing is based on consent.
  • 7.1.3. Require the Operator to clarify, block, or destroy personal data if it is incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the declared purpose of processing.
  • 7.1.4. Receive information regarding the processing of personal data to the extent determined by the legislation of the Russian Federation.
  • 7.1.5. Exercise other rights provided for by the legislation of the Russian Federation.

7.2. The User undertakes to:

  • 7.2.1. Not provide the Operator with personal data of third parties except where such provision is permitted by the legislation of the Russian Federation and based on proper legal grounds.
  • 7.2.2. Provide the Operator with accurate and up-to-date personal data.
  • 7.2.3. When providing information about third parties, independently bear responsibility for having the necessary legal grounds for such provision.

7.3. The Operator has the right to:

  • 7.3.1. Process personal data in accordance with the legislation of the Russian Federation and this Policy.
  • 7.3.2. Independently determine the composition and list of measures necessary and sufficient to ensure compliance with obligations provided for by the legislation of the Russian Federation on personal data.
  • 7.3.3. Provide the User’s personal data to third parties in cases and in the manner provided for by the legislation of the Russian Federation and this Policy.

7.4. The Operator undertakes to:

  • 7.4.1. Process personal data in accordance with the purposes specified in the Policy.
  • 7.4.2. Ensure personal data processing in accordance with the legislation of the Russian Federation and this Policy.
  • 7.4.3. On the grounds and in the manner provided for by the legislation of the Russian Federation, clarify, block, or delete the User’s personal data.
  • 7.4.4. Take necessary measures to ensure the security of personal data.
  • 7.4.5. Fulfill other obligations imposed on the Operator by the legislation of the Russian Federation.

8. Final Provisions.

8.1.1. Any disputes arising out of or related to the Policy shall be resolved in accordance with the legislation of the Russian Federation, subject to mandatory pre-trial dispute resolution procedures unless otherwise provided by the legislation of the Russian Federation.

8.1.2. If any provisions of the Policy are declared invalid by a court, the remaining provisions of the Policy shall remain in full force and effect.

8.1.3. The Operator reserves the right to unilaterally amend and supplement the Policy at any time. The updated version of the Policy becomes effective from the moment it is published on the Website. Continued use of the Website after amendments to the current Policy constitutes acceptance of such amendments by the User.
